For those who received final removal orders from immigration court because of "old" criminal convictions. Many of them gave up their rights and signed deportation orders because, at the time, deportation to Vietnam was not possible for those who arrived before 1995.


They have the right to challenge the removal order, and a great first step is to explore options like Post-Conviction Relief (PCR) or seeking a pardon. If successful, they can then file a motion with the immigration court asking the judge to reopen the case and terminate the final removal order.


Post Conviction Relief

  • Contact your local Public Defender’s Office or an experienced criminal defense attorney ASAP to explore possible relief options. If your conviction occurred in California, there is a high likelihood that your case may be eligible for relief.


PARDON

  • For state convictions, apply through your state’s Governor’s Pardon Office.
  • For federal convictions, apply through the U.S. Department of Justice (DOJ) Office of the Pardon Attorney. click here


Motion to Reopen & Terminate

  • Retain an experienced immigration attorney ASAP after successful with Post-Conviction Relief (PCR). This step is most likely to succeed if the Post-Conviction Relief (PCR) or pardon is granted.

Cách "đánh case"

Đối với những người đã nhận lệnh trục xuất (final removal order) từ tòa án di trú vì những bản án hình sự cũ. Nhiều người trước đây đã từ bỏ quyền của mình và ký vào giấy đồng ý trục xuất. Lý do là vì vào thời điểm đó, Việt Nam không nhận  người bị trục  xuất đối với những người đến Hoa Kỳ trước năm 1995.


Họ có quyền yêu cầu tòa án xem xét lại lệnh trục xuất, và bước đầu tiên có thể làm là tìm các biện pháp Xóa Án, Post-Conviction Relief (PCR) hoặc ân xá (pardon). Nếu thành công, họ có thể đề đơn lên tòa án di trú yêu cầu thẩm phán mở lại hồ sơ (motion to reopen) và hủy bỏ lệnh trục xuất..


Xóa Án / Post Conviction Relief

  • Biện pháp Xóa Án không phải là "seal" hay "expunge". Hãy liên lạc với Văn phòng Public Defender tại địa phương hoặc luật sư bào chữa hình sự có kinh nghiệm trong thời gian sớm nhất để xem xét các khả năng cứu xét pháp lý.
  • Nếu bản án của bạn xảy ra tại California, rất có khả năng cao là trường hợp của bạn có thể  đủ điều kiện cho việc Xóa Án, Giảm Án, hoặc cứu xét lại bản án.


Ân Xá / Pardon

  • Đối với án của tiểu bang, đề đơn ân xá thông qua Văn phòng Ân Xá của Thống Đốc tiểu bang.
  • Đối với án liên bang, đề đơn thông qua (U.S. Department of Justice) – Office of the Pardon Attorney. click here


Mở Lại Hồ Sơ & hủy bỏ Lệnh Trục Xuất

  • Bước này có khả năng thành công rất cao nếu việc hồ sơ Post-Conviction Relief (PCR) hoặc ân xá được chấp thuận. Liên lạc với luật sư di trú có kinh nghiệm ngay sau khi xóa án được thành công.
